With the unceasing development of modern society, air transportation,which symbolizes high efficiency and speed, expands immediately. However, a number of its disadvantages are revealed at the same time. The most annoying of them is flight delay, which bothers airlines, passengers and even legal clerks as well as blocks improvement of its own.In this paper, examples will be taken to introduce a variety of focused legal problems, responsibility of flight delay and the supposed and realistic attribution principle in China. To solve the problem of flight delay in China under the state of law and order properly, the most important point is defining the flight delay in legislation. The flight delay can be divided into two situations, reasonable delay and unreasonable delay, so that the scope of liability for breach of contract born by the carrier can be determined and the doctrine of liability fixation of the inverted burden of proof can be definite. The researcher will analyze the legislation and justice of domestic flight delay, investigate cases internationally or in developed countries. What's more, some practical suggestions are proposed, including improving legislation on flight delay and supplementing insurance system of flight delay.
