With sustained briskness of China's second-hand real estate market, there has been an increasing number of real estate transaction disputes in recent years, including disputes in which the real estate is considered as "stigmatized property". Therefore, a study on legal issues of transaction of "stigmatized property" is of realistic significance.This paper includes four chapters. Chapter I introduces two sales contract disputes related to "stigmatized property" and the adjudication of one dispute amongst the two. Chapter II summarizes and discusses focal problems arisen from these two disputes in common. Chapter III elucidates and analyzes relevant jurisprudential problems, which are contracting fault liability of the seller, character of defect of "stigmatized property" and defect warranty liability of the seller, and analysis of the intermediary's liability. In Chapter IV, this paper draws conclusions based on preceding analysis. By taking the pending dispute introduced in chapter I as an example, this paper tries to propose corresponding solutions to transaction disputes related to "stigmatized property" under two different situations as well as brings forward precautionary measures to similar cases. |
