In the absence of social credit, it has caused the occurrence of false litigation, and this should be a tool for the illegal use of civil action, which is a tool to seek illegitimate interests. The so-called false litigation refers to the parties to obtain illegal interests, malicious collusion, false evidence fictional legal relationship and legal facts, through the legal proceedings to induce the court to make a wrong judgment, or the use of false arbitral awards, justice instruments for the implementation of fraud, damage to the state, the collective or the interests of the third.This paper is divided into three parts, the first part of the basic meaning of false litigation to be summarized, the literal meaning of the false litigation to be in-depth analysis, combined with the theory of different views of the meaning of false litigation to try to summarize the basic meaning of false litigation. In the second part, the paper summarizes the current situation of the false litigation, summarizes the types of false litigation, analyzes the causes and harms, and studies the status quo of the false litigation, and provides the basis for the third part of the article. The third part is mainly on how to regulate the false litigation, mainly from the legislative level, the judicial level and the integrity of the construction of the relevant recommendations, through legislation to provide legal basis for the regulation of false litigation. In the judicial practice, it is to improve the ability of the false litigation, and to improve the effectiveness of the regulations. Efforts to build a social credit system, the masses of good faith education, strengthen the integrity of the building, from the root of the false litigation.
