In recent years, the Third-party Internet payment industry is developing rapidly in our country, and the scale of it is larger and larger. It is reported that the number of the non-financial institutions conducting the registration of payment service in the People's Bank of China and its branches at present has reached several hundred.However, the rapid development of the industry inevitably accompanied by a variety of problems, of which the legal issues are the most highlighted.It mainly shows the lack of the relevant legal system of supervision on non-financial institutions and the customer provision, and the lack of it makes customer provisions take many legal risks. Meanwhile, due to the problems of the excessive registered account number of payment institutions in the real operation, the scattered forms of opening accounts, the obscure and complicated relationships between multiple accounts, the various ways of own reserves and so on, it will cause a series of serious social problems if there is no reasonable and effective legal regulation of supervision on Customer Provisions.Therefore, it is necessary to effectively supervise the customer provisions.In 2010,China's central bank introduced "non-financial payment services management method" which clearly stipulates to bring the third party payment institutions into the scope of legal adjustment;On June 7, 2013, it successively promulgated “the storage methods of the Customer Provisions in payment institutions", focusing on the relevant supervision to Customer Provisions. Even so, our supervision system to customer provisions is still not perfect, existing all kinds of shortness and problems.This paper is mainly divided into four parts to explain the supervisory system to Customer Provisions.The first part focuses on the connotation of the Customer Provisions and the current situation of supervision on Customer Provisions in China. This part analysis the concept of Customer Provisions and the appearance of its problems, and explains the current situation of supervision on Customer Provisions, mainly including the legislation present situation and the judicial practice situation.The second part specifically analyzes the legal problems existing in the customer provisions in our country. It mainly explains from the drifting supervision of the third-part payment, the rigid regulatory legislation and the protection of customers.The third part is the description of the foreign customer provision supervision system. It mainly analyzes the supervision system in United States and the European Union. And through the comparison with the current supervision situation and system in foreign countries, it summarizes the advantages of their supervision system,pointing out what China should draw lessons from other countries.The fourth part mainly puts forward some suggestions to improve our existing customer provision supervision system. In this paper, it aims to improve the customer provision supervision system from the internal and external parts of the payment institution.
