"Criminal law amendment(eight),add the crime of dangerous driving crime.Traffic offences,driving method of collision risk endangering public security and the relation and distinction between this crime has a lot of."Criminal law amendment(nine)to further modify the dangerousdriving crime,increase the overload overspeed driving in the bus or passenger transportation cause serious personal casualty accidents,constitute this crime.However,the Provisions of this crime criminal law "motor vehicles","drunk","carriage of passengers by terms such as" both in the process of judicial cognizance there is not clear,it is necessary to through certain forms to define the concrete scope.In judicial practice,this crime especially for drunk driving type of dangerous driving sin more and more tend to simple quickprocedure,therefore,judicial authority has established in individual cities and start the traffic speed cutting chamber to solve this crime.In terms of criterions for the conviction,due to the characteristics of the authority of criminal law,the new rules strictly apply ShiXing rate at the beginning of this crime,up to now has slowly evolved into later short-term trend of criminal detention,the lesser,also can apply probation,but from non punishment disposal measures such as criminal penalties applicable rate is still low.To solveabove problems,this paper made a brief analysis for dangerous driving crime in recent years,put forward about punishment of dangerous driving crime in the judicial practice in our country two suggestions.
