The Procuratorial Organ Applies The Normative Study Of Technical Investigation Procedures

The "Criminal Procedure Law" establishes the legal status of the technical investigation measures taken by the procuratorial organs in the investigation of duty crimes.However,the legal provisions of the applicable technical investigation procedure are too broad,vague,or even absent.This thesis takes two practical cases as a breakthrough,leads to problems of technical investigation procedure legislation of our country,through the comparative research method,based on technical investigation contents of law,the legal provisions on the technical investigation of major foreign countries in the comparative analysis,study and improve the procuratorial organs to take legal application of technical investigation measures the legislation.This paper is divided into seven parts.The first part is the introduction,which explains the background of the topic,literature review and the source of the case.The second part is the body part,through two cases,it leads to the legislative defects and deficiencies of the legal procedure of the procuratorial organs in our country.In the third part,the author discusses the concept,characteristics,potential risks and legal significance of technical investigation,and clarify the legal connotation of the technical investigation procedure.The fourth part and the fifth part is the main part of the paper,through the comparison of legal provisions on the technical investigation of major foreign countries,analysis of procedural issues and shortcomings of China's procuratorial organs application of technical investigation measures.The sixth part is to improve the legislation of procuratorial organs,the application of technical investigation procedure in our country finally,based on the summary of the whole content,from the contradiction between the protection of citizen privacy and perfection of legislation of technical investigation,legal regulation of innovation of China's procuratorial organs apply the measures of technical investigation procedures,can enhance the ability of the procuratorial organs to combat a crime,but also can fully protect the privacy of citizens.
