The abolishment of regulations concerning rewards and disciplinary sanctions of employers in 2008 and the current absence of law on the employees who break the regulation in their companies often lead to the conflict between labor and capital in state-owned companies. China's Labor Law has only one clause on the employees'legal responsibility, which, in most cases, is supplemented by the working contract or the company's own regulations. Disciplinary regulation, functioning as one of the working laws and regulations, is closely connected with the right of operation and management of the state-controlled corporate.Based on the current administrative system, this paper is designed to solve the problems in the labor-capital management and make a research on the necessity and practicality that the state-run corporation makes its own disciplinary regulation. The paper, focusing on the rights and obligation of the employees in Shaanxi Broadcasting Television Network, makes a deep analysis of the law feature of the labor-capital in such state-owned company. Furthermore, it explores the legal backing, which ensures the legality of the subject, content and procedure of the regulation. Last but not least, compared the relative laws and regulations domestic and abroad, the thesis points out that the company, under the principle of appropriateness and equality, has the right to give punishment to its employee who breaks the rules or cause damage to the reputation or finance to the company. Through the study of the benefits and flaws that the disciplinary regulations brought about in Shaanxi Broadcasting Television Network, this research proposes some constructive suggestions on how to perfect the management in the state-run company so as to give some assistance on the better implement of disciplinary regulation.
