Investigation Report On The Administrative Reconsideration System In Ningxia

At present, the reform has entered into a critical stage in China, a large amount of contradictions and disputes produced from the profound changes in economic administrative system and the complicated and diversified interests so that urge the government to make innovations in the social administration. In recent years, the governments at and above the county level and their departments, giving full rein to the important role the administrative reconsideration played in resolving administrative disputes and social conflicts with the advantages of providing convenience to the people to apply and effective and flexible ways to handle the cases and easy to implement, etc., handled the administrative disputes justly and timely according to law, a large amount of illegal and unjust administrative behavior have been rectified and the lawful rights and interests of the people were protected, the administrative disputes were handled within the administrative system. But some problems have arisen at the same time, such as:the lack of the administrative reconsideration organs and the staffs made serious effects on handling administrative reconsideration cases; the faulty function of administrative reconsideration dues to the low efficiency that the disputes handle by administrative reconsideration; the publics have low confidence about the administrative reconsideration because of the high rate of maintaining the administrative decisions. The system of administrative reconsideration did not make the most of the advantages and play an important role in resolving the administrative disputes because of these problems, and the pressure on the departments of letters and calls did not relieve effectively. Aimed at these problems, this paper starts from the basic theory of administrative reconsideration, combines the historical background of administration according to law and constructing law-based government, analyzes the current situation, problems and causes with taking the administrative reconsideration of Ningxia Hui Autonomous Region as the example and proposes a series of countermeasures and suggestions through comparing to the successful practice of the administrative reconsideration system reform in China.This paper, taking problems as the guidance and empirical study as the basic way through the study ideal of present situation, problems, causes and ways to resolving, consists of three main parts. The first part is mainly about the concept, features, development, function of administrative reconsideration, which takes comprehensive study and reorganization on mainstream view of theory of administrative reconsideration in China and expounds the basic theory of the administrative reconsideration system. The second part, combining the practical situation of Ningxia, analyses a large amount of data of administrative reconsideration cases in Ningxia and compares to the data with other provinces, sums up the current running state of administrative reconsideration, founds out the problem existing in administrative reconsideration and analyses the causes thoroughly through counting the data of administrative reconsideration cases these years. The third part, in connection with the problems existing in administrative reconsideration system, proposes countermeasures and suggestions in such respects as relocation of function and system reform of administrative reconsideration, expanding scope of accepting administrative reconsideration cases and improving the administrative reconsideration procedures,.
