Research On The Legal Regulation Of Fictitious Original Price Behavior

The price is the way of communication between the market economic actors.In the economy society,the economy can not run without the price,price competition affecting the market competition,fair price competition is the key to ensure market order.However,many improper price means have seriously disrupted the normal market competition order.Original fiction in which the Price gouging is particularly widespread,It not only makes the legitimate interests of consumers and other operators have been infringed,it is caused by a disorder of the market economic order,causing unnecessary waste of social resources,it is necessary for the conduct of legal regulation.Our original fiction acts on regulation is mainly reflected in the laws and regulations of the price,However,due to the price laws and regulations,does not individually regulate the original fiction,Instead,it is regulated in the price-gouging.This leads to original fiction behavior failed to effectively regulate in the practice.Based on consideration of the establishment of a sound legal acts original fiction regulation system,We can refer to the experience of foreign countries,from the Price Law,Consumer Protection Law,the Anti-Unfair Competition Law to regulate original fiction behavior in order to establish a sound regulatory system.This article discussed from four aspects:Part I:Firstly analysis the Chinese price laws on the definition original fiction behaviour,demonstration of the unreasonable regulations,and put forward his opinion on fictional original price behavior defined;Second,respectively,from the Angle of price law,consumer rights and interests protection law,competition law,legal qualitative behavior of the original fiction,its adjustment should be subject to the above three method;Finally,introduced the causes of fictional original price behavior and the harm.The second part:Based on the price law,consumer protection law,unfair competition law perspective,analyzed three laws regulating the behavior of original fiction,and its deficiencies.Part III:Through the introduction of Anglo-American law system and continental law system countries respectively set up in legislation,law enforcement agencies,regulation measures on fictional Settings with a third party price behavior regulation experience,sum up five is significance for regulating the original fiction.Part IV:with China's Price Law,Consumer Protection Law,the Anti-Unfair Competition Law to regulate the behavior of original fiction inadequate experience and relevant outside reference,respectively,from the Price Law,Consumer Protection Law,Unfair Competition Law proposed regulation to improve the behavior of original fiction suggestions angle.And discusses the legal regulations the application of original fiction.
