Research On The Legal System Of Shale Gas Mining Rights Management In China

At present,the energy demand of each country is increasing,and the consciousness of environmental protection is awakening and gradually increasing.People turn their attention from the conventional oil and gas resources to the unconventional oil and gas resources,renewable resources,nuclear energy and other clean energy.Shale gas,as a member of unconventional oil and gas resources,have huge reserves in the world.According to the survey,China's shale gas resources are rich,which has a major strategic significance to ease China's rising demand for natural gas.The state attaches great importance to the exploration and exploitation of shale gas,therefore,they promulgated a series of policies and regulations to promote the industrialization and large-scale development of shale gas.Among them,the problem of shale gas mining rights has become an important problem restricting shale gas industrialization,large-scale development.The moment study of shale gas,the comments mostly involve the shale gas technique,the prevention of environmental pollution,and etc.For the management of mining right,the law is simple.It allows private enterprises and other social investment into the field of shale gas.However,the access standards for shale gas mining rights,mining order,exit system,circulation conditions and regulations are not perfect.This paper studies is based on this background.This paper which is from the idea of finding problems,analyzing problems and put forward suggestions,analyzes the problems of China's shale gas industry of mining rights.And then,based on its existing problems,I learn good practices from the United States,Poland and England.Through improve the related system of China's shale gas mining rights management,to achieve the development of the China's shale gas industry.This paper consists of three parts:introduction,text and conclusion.The introduction introduces the background,present situation and the significance.And in this part,whether the release of mining rights is discussed emphatically;the body consists of four parts,the first part introduces the status of shale gas and mining rights management,and the second part deeply analyzes the problems of shale gas mining rights management,which include the access,exploitation,withdrawal,transfer and regulatory issues.The third part is about the study of the United States,Poland and the UK.We can learn good practices from them.The last part,I put forward some proposals to complete the legal system of mining rights of shale gas in China.Finally,I come to a conclusion that we must release the mining rights,run the multi-level regulatory system,and improve the legal system of shale gas mining rights management.
