Legal Thinking On The System Of Regional National Autonomy In China In The Process Of Globalization

When we thinking about the domestic ethnic relations of countries in today's world,it is hard to avoid the macro historical background of globalization and China's ethnic policy and culture will be surely impacted by the expansion of the Western political idea,national system and ideology which are situated in the tide of globalization.When considering our ethnical issues,we should draw lessons from the experience of our history and that of other countries in dealing with ethic relations.This dissertation is from the basic perspective of constitutional theory,centering on the theme of China's national regional autonomy,combined with different models and experience of national autonomy in the world and finally putting forward some specific suggestions in improving our system of regional national autonomy.In the first chapter,it mainly analyzes the development trend of the national policy and issues the multi-ethnic countries in the world are facing,which under the background of globalization.Nowadays,there are mainly four types of ethnic policies in multi-ethnic countries which are national assimilation policy,national decentralization policy,multicultural policy and national integration policy.Under the background of globalization,the trend of the national issues in the world is becoming internationalized and complicated with the national consciousness enhanced and the assimilation of the core elements of ethnic culture is becoming more and more important.The second chapter focuses on the investigation of the specific policies of different countries in dealing with their domestic ethnic issues,also the practical use of these policies and the relevant provisions beyond border.The countries' ethic policies in the world are different from each other,so in this part there will be an analysis on ethnic policies of Britain,Spain,Singapore,Russia and other countries and will make a summary about problems and experience of these countries in the process of dealing with their domestic ethnic issues.The third chapter focuses on the analysis of the current situation of China's regional ethnic autonomy system.Analyzing the nature of the regional national autonomy system and the logical relations between autonomy and regional national autonomy.These two concepts are subordinate relationship from the extension perspective and from the intention perspective they belong to two progressive levels.In this chapter,the author also distinguished the basic concept of "national self-determination","national autonomy" and "national regional autonomy".National self-determination,national autonomy and regional national autonomy are three concepts that are interrelated but also quite different from each other."National self-determination" and "national autonomy" are analyzed from the perspective of domestic and international concepts.From the perspective of the allocation of public power,the international community "autonomous regions" put particular emphasis on the vertical allocation relations of it and the "autonomous rights" under the organs of regional ethnic autonomy in China emphasize the lateral comparison relations of public power.Under the background of globalization,the author will tell what the unique institutional advantages of our country's national policy have and analyze the existing issues existing in our national autonomy system and the difficulties under the background of globalization.In the context of globalization,the enhancement of national consciousness could spread to national autonomous areas and the promotion of globalization will also make the ethnic minorities' traditional culture which in a weak position suffer a severe erosion.Because of the backwardness and large gap,globalization oriented by benefit will make the regional national autonomy face the threat of being "marginalized".The forth chapter focuses and bases on the lessons learned from other countries and puts forward suggestions that can improve the regional ethnic autonomy.Based on the issues the regional national autonomy system of China is facing under the background of globalization,we should respect and protect the cultural rights of ethnic minorities;cultivate the sense of political responsibility of ethnic minorities;improve their political identity and quality;enhance the belongingness of all ethnic groups to the country;educate citizens of various ethnic groups to prompt the national consciousness in a proper way;earnestly guarantee the autonomous right;make use of autonomous right to coordinate contradictions between local policies and rules of WTO and achieve the goal of establishing and improving the national legal system.
