Research On The Legal Issues Of Autonomous Cooperatives In Agricultural Land Cooperatives

Rural land stock-cooperative,as one of the professional farmer's cooperatives,is a land utilization type,which is created at the reformation of the household contract and management system.It innovates and develops the rural land circulation patterns.On the premise of confirming ownership,guaranteeing contract right and encouraging management right,we concentrate and optimize land resources by the pattern of joint-stock partnership.Rural land realizes marketization and scale development.But the lack of elemental study of theories and delay of legal norms make rural land stock-cooperative encounter some problems,and they hinder the development of land stock-cooperative.In this paper,rural land stock-cooperative is put in the marketization of modern agricultural construction.Ownership allocation and income distribution are seperated from the system,making them easier.I find the root of the problems by analyzing legal status,internal governance mechanism and government supervision of rural land stock-cooperative.Therefore,I make some suggestions about the governance of rural land stock-cooperative.This paper includes five parts:Part 1:Raise of problem.By research the case of rural land stock-cooperative in Chenzhou,Hunan Province,I affirm the developing status of rural land stock-cooperative under the government support,and tease some problems of the autonomy in most rural land stock-cooperatives.Part 2:The legal status of rural land stock-cooperative.I realize the current situation of legislation of rural land stock-cooperative.I present its embarrassing legal status,giving rise below.Part 3:Internal governance of rural land stock-cooperative.By clearing up the internal organizational structure of rural land stock-cooperative,I analyze and research its governance difficulty,then I give some advise.Part 4:Extemal governance of rural land stock-cooperative.List the problems in government supervision and relevant law gaps.I put forward some suggestions,so we can make a better external supervision system.
