Rural Governance And Its Rule Of Law In The "semi-acquaintance Society"

Along with the development of modem city,speeding up the process of kinship identity of rural social ties impact,instead of the contract type of rural social order to geopolitical relations and interests as the center;however,from acquaintance society to stranger social transformation,there is one from traditional to modern,from static to dynamic and identity by descent to the geopolitical contract transition society,namely "semi acquaintance society"."Semi mature society" is a chaotic state of "rule by law","rule by man","rule order"and "patriarchal order",and it is also a temporary social form in the transitional period.In the semi acquaintance society,rural governance is facing three major problems:first,the legal governance of the universality and particularity of the problem,mainly for the national law and conflict;second,the state power to the autonomous organization intervention and control,the outflow of the unfavorable factors of villagers autonomy the third threat;the civil rights of the farmers are not protected.Reflection on the dilemma of rural governance in the "half man society" and the experience of American grass roots governance.First,the United States attaches great importance to the building of the legal system of local governance,clearly define the various levels of government authority,and to limit the power of the government,to fully protect the citizen participation in local public affairs governance rights.Second,the basic level of the United States has an independent society,the relationship between the township and its higher government,there is no administrative affiliation.Third,cultivate the consciousness of civil rights,so that the majority of citizens to participate in the management of local government public affairs.Finally,starting from the perspective of the rule of law,to solve the dilemma of rural governance scheme,including five paths:national law and folk regulations about the benign interaction;improve the system of democratic self-government;limited government,straighten out the power boundary;eliminating the difference between urban and rural,to protect farmers rights;promoting rural governance from legislation three,judicial and administrative dimensions.Rural governance law not only provides a theoretical basis for the party and the country to formulate policies on rural governance,and to establish a sound legal system,the unity of the township government to continue to deepen the reform of the management system,improve the system of village autonomy,has great practical significance to improve the rural grassroots governance system.
