Research On Husband And Wife False Debt Regulation

In recent years,due to divorce caused by debt disputes are common.China's current marriage legislation emphasis on protecting the interests of creditors and at the same time,ignoring to protect the interests of the husband and wife debt.With the change of the times and the development of the economy,the husband and wife to increase foreign trade;increasingly independent personal relationship between husband and wife,the divorce rate rising,driven by the interests the phenomena that one party of the spouses malicious collude false debt with the creditors often happen,couples false debt is often presumed to be a common debt of husband and wife,which seriously damaged the legitimate rights and interests of husband and wife in China.The law urgently needs to regulate the false debts of husband and wife.This thesis is divided into three parts.The first part focuses on the content of false debts,including the connotation of the false debts and the legislation related to the false debts.The second part focuses on 93 related practical analysis of the false debts of couples.The last part is about the husband and wife false debt regulation recommendations,combined with China's actual situation and learn from the extraterritorial legal provisions,mainly from the legislative and judicial aspects of the two elaborated.Hope this article can be discussed for the judicial practice in the practice of husband and wife debt disputes,with a view to the next civil code marriage family to further improve China's couples debt system!...
