Research On Prepaid Consumer Law Issues

Prepaid consumption is a new consumption pattern.From the perspective of consumers,prepaid consumption save time to pay cash for change,while also bring the price concessions.From the perspective of operators,prepaid consumption can effectively absorb tourists,and at the same time can raise funds in a short time to save the enterprise cost.Because the legal regulation of prepaid consumption in China is not perfect,not only the risk of consumers' rights and interests,but also the market economy and social management order are also a certain degree of negative influence.Therefore,this paper is divided into four parts to analyze the legal issues of prepaid consumption.The first part of this paper lists the typical cases of prepaid consumption,and puts forward the legal issues of prepaid consumption mainly include the special legal attribute of prepaid consumption,the special legal risk of prepaid consumption and the perfection of the legal regulation of prepaid consumption.The second part of this paper mainly analyzes the legal attribute and legal risk of prepaid consumption.This section first defines the meaning of prepaid consumption,and defines the prepaid consumption as purchasers to pay a certain amount of the cost to prepayment,and the cardholder can enjoy the goods or services provided by the operator,and pay a consumption pattern with prepayment.Secondly,the legal nature of prepaid consumption,mainly analyzes the legal nature and legal structure of prepaid consumption.Finally,the special consumption risk of prepaid consumption is summarized.The third part of this paper is to study foreign legal regulation of prepaid consumption.Mainly study the legal regulation of prepaid consumption in the United States and Canada and the legal system of Japan about prepayment,provide experience for the development and perfection of legal regulation of prepaid consumption.The fourth part of this paper expounds the legal regulation of prepaid consumption in China,the legal regulation of prepaid consumption in Taiwan is relatively perfect,but many problems need to be improved in the legal regulation of prepaid consumption in mainland China.The author puts forward three suggestions to improve the legal regulation of prepaid consumption in China by reference to the experience of prepaid consumption law in foreign countries and Taiwan region.
