Research On The Prohibition Of Competition In The Protection Of Trade Secrets

In the economic globalization today,the continuous innovation of science and technology will be increasingly fierce competition to the white-hot stage.21 st century,the competition of modern enterprises is the competition of science and technology information and talent,science and technology and talent has become the lifeline of enterprises,so how to protect the business secrets,to prevent the loss of professionals become a focus of contemporary law.In our country has not yet formed a trade secret with the legal system,so at this stage of China's legislative direction is the introduction of a unified "Trade Secrets Protection Law",it is necessary to protect the business secrets belonging to the enterprise but also to rationally safeguard the legitimate interests of workers.Competition is prohibited by the agreement,most companies are used to protect their own business secret effective means,but at present our country in the law only made a general rule even in the judicial interpretation of the ban on non-competition agreement is also blurred,this situation to our practice in the case to solve a great problem.Therefore,this paper adopts the discussion method of the specific case analysis,and then puts forward some legislative suggestions and hopes to help the judicial practice.
