Thoughts On Constructing The System Of Immunity Testimony Of Tainted Witnesses In China

At the current stage,China's corruption crimes and smuggling,gangdom,drug trafficking,etc.which organized and planned work activities lead to the number of crimes against society is increasing.In order to investigate and attack a series of criminal activities more effectively,maintaining social fairness and justice is a major challenge for the investigation organs.The immunity system of tainted witness(hereinafter referred to as The Immunity of Tainted Witness System)is the role in the investigation of these major cases,can be used as an effective means to obtain important evidence and clues of the case,and can radically solve the problem of obtaining evidence.In China's criminal procedure stipulates against self-incrimination,and certain legislation such as voluntary surrender,meritorious service,non-prosecution system all has a positive effect on the establishment of the immunity of tainted witness system in China,provides a good foundation and effective guarantee for our country to establish the system.I think,the establishment of immunity system of tainted witness in our country is the need of the construction of rule of law;Therefore,there is no need to elaborate on the necessity of constructing the immunity system of tainted witness in our country.This paper will focus on some related concepts including the scientific analysis of tainted witness criminal immunity,immunity of tainted witness system concept,and their characteristics and values.;combined with China's current legal system and standard basis of immunity of witness system in full from the foreign representative countries,put forward specific ideas on how to perfect the legislative basis and system construction of the immunity system of tainted witness in our country.
