Electronic commerce rapid development today,the network shopping because of its characteristics of fast,convenient,save time,by most consumers,have to catch up with the momentum of the traditional shopping way.At the same time,consumers' rights and interests protection problem has become a constraint network shopping sustainable development bottleneck problem.Electronic commerce electronic,open features,make the network shopping was born of the greater than general shopping uncertainty and risk.Shoddy,selling counterfeit and shoddy goods,false discount,hire people brush evaluation,refused to consumer to give bad review,dummy return threshold,leaks consumers personal information,etc.,to online shopping,that is the main focus of dispute,causes the network shopping consumer transaction security,the right of fair trading right,right,in accordance with the law claims,such as privacy rights and interests are threatened.And because the network shopping there is biggish difference in many aspects and the traditional shopping,the current law can't systematic regulation for it.This article combined with the current situation of the development of China's online shopping,study other countries advanced the regulation of the network shopping system,in order to further improve the system of our country's network shopping consumer rights protection laws regulations make Suggestions,in order to build a healthy network shopping environment,the real timely and effectively protect the lawful rights and interests of the network shopping consumer,provides consumers with more reassuring network shopping environment.This paper is divided into three main parts:The first part is the empirical analysis of network shopping consumer rights and interests protection.According to the latest data summary and analysis of statistics,this paper expounds the network shopping consumer rights and interests by the phenomenon,put forward the existing problems to be solved.Specifically,the present situation of online shopping in China is not optimistic,the rights and interests of consumers suffering from all kinds of challenges:transaction security right face many threats;Internet advertising false information,infringement of the right of consumers' right to know;Business email and text message,influence the realization of autonomous choice;Operator is wanton speculation,fair trading right vulnerable;Personal information leakage,privacy can not get effective protection;After the occurrence of tort relief difficulty,damage compensation request.Investigate its reason,mainly is the online shopping market access threshold is low,the seller the good faith management consciousness is poor;The third party trading platform supervision does not reach the designated position;Network supervision system is not perfect,regulatory review regulatory enforcement;The lack of a sound and effective legal relief system.The second part is the main countries of two important legal systems the legislation experience and draw lessons from.Mainly chose three more representative countries,the United States,the European Union,Singapore,the three countries of e-commerce legislation are mature,some of the advanced system is of great significance to our country.The third part is the legal system of consumer rights protection in China.According to the former three parts of introduction and analysis,together with the present situation of China's online shopping,improve the network shopping system of legal norms.This article mainly take the case analysis,comparative research and reference analysis,has discussed the network shopping consumer rights and interests protection in China briefly the legal analysis,and boldly put forward the corresponding countermeasure and the suggestion,hope to China's online shopping consumer rights protection work contribution,so as to encourage healthy and sustainable development of China's online shopping.
