On The Application Of Criminal Reconciliation

The study of criminal reconciliation has been in China for a long time.The newly revised Criminal Procedure Act of 2012 incorporated criminal conciliation as a special procedure into law,and criminal reconciliation has gone through a process from practice to institutionalization.The traditional retaliatory justice,directly ignores the wishes and expressions of the parties,especially the neglect of the rights of the victims.The criminal reconciliation fully respects the wishes of the parties and protects the rights of the parties,with a focus on repairs to the damaged social relations rather than to the defendants.Criminal reconciliation as a new judicial system,and the idea of building a socialist harmonious society in our country is highly unified,thoroughly implement the criminal policy of our country's temper justice with mercy and also coincides with the ancient Chinese tradition.The Criminal reconciliation system has become mature in the western countries,but because of the different cultural soils,China's criminal reconciliation system is still in the exploratory stage,there are many problems,such as the law of the provisions of a fuzzy,single performance,misunderstanding,lack of supervision mechanisms,etc.Criminal reconciliation system perfect application is imminent.
