Research On The Crime Of Polluting The Environment

Environmental pollution has always been the focus of global attention and the key problem to solve as well;China's environmental problems are particularly severe.In 2011,<the Criminal Law Amendment(8)of the People's Republic of China>changed the crime of "serious pollution of the environment" to Article 338 of the Criminal Law as "the crime of polluting the environment",which reduces the threshold of the crime and expand the scope of the pollution.At the same time,in 2013,the implementation of the<Supreme People's Court,the Supreme People's Procuratorate on the handling of environmental pollution criminal cases applicable to the interpretation of a number of issues>which is sufficient to illustrate our country's attention to environmental issues.Even though the criminal law as the last resort to protect the environment made some progress but there are still lots of existing provisions remain.This paper discusses the existing problems of our country from the background of China's polluting environment.It is pointed out that China has not discussed the problems of guilty and negligent crimes,and stipulated the results and neglected the dangerous crimes and the imperfections.Finally,the solution to the existing problems,it is proposed to add dangerous offenders,will be deliberately committed with the offenders,respectively,in order to improve China's pollution environmental legislation.
