The General Secretary Xi Jinping told us "try to make people feel fair in every judicial case ",with the criminal misjudged cases of Peiwu Du,Xianglin She gradually disclosed by the media,criminal misjudged cases have been the focus of attention,and the identification problem is undoubtedly the most important in the criminal misjudged cases,the mistakes in forensics can lead to misjudged cases.Starting from the typical cases,the paper analyzes the identification problem of criminal misjudged cases,including the macro-level forensic system,the meso-level identification procedure and the micro-level evidence rule and so on,on the basis of in-depth theoretical and practical research,and according to the existing legal provisions and learning from the system of forensic forensic,we can put forward countermeasures: First,reform the identification system,change the present situation that the authentication and investigation belong to a system,Improve the system of unified judicial administration to achieve the separation of detection.Secondly,standardize the procedures of identification,make a Standardization to start the identification procedures,make a sound legal system of surveyor to testify in court,improve expert assessor system and inform expert opinion procedure.Once again,strengthen the management of the surveyor to ensure the smooth conduct of forensic activities,and finally,strengthen the supervision of the activities of the identification,to realize judicial justice.Although the judicial appraisal system still exists many defects and deficiencies at present,with the judicial appraisal system constantly reforming and improving,our country will be able to maximum to avoid the occurrence of misjudged criminal cases.
