Research On The Docking Mechanism Of China's Prosecution And Adjustment Under The Marxist Mass View

The litigation and mediation connection is an important practical achievement of our country 's multiple dispute resolution mechanism.It has the advantages of making full use of social resources and being closer to the masses in dealing with internal contradictions and resolving disputes among the people.How to establish a diversified dispute settlement mechanism,properly handling the social disputes in development and effectively responding to the special needs of the people are the key to safeguard the fundamental interests of the overwhelming majority of the people in the process of social transformation.From the perspective of Marxist mass view,this paper studies the litigation and mediation connection,which is conducive to effectively resolve the various types of contradictions and disputes facing the people,and then promote its new development under the guidance of the Marxist view of the masses.This paper consists of four parts.The first part is the interpretation of the Marxist view of the masses,which interpret the concept,the practical value and practice path of the mass view.The second part is the study of the litigation and mediation connection,which defines its concept and analyzes the current development status and operation mode.This part sums up the difficulties and problems in the course of serving the masses.They are the poor channel of interface,narrow interface,unfair hidden trouble,imperfect mediation network,lack of awareness of the masses,lack of legislative support and system security,and so on.This part combined with the Marxist mass viewpoint,from the subjective aspect,points out that the root of the problem is the dim consciousness of civil servants in people-oriented and serving the masses concept,the poorly understanding of people's power subject status,and paying no attention to the importance of the people as the decisive force of social change.The third part is the analysis of the value of the litigation and mediation connection,which analyses the current legitimacy and necessity combined with the Marxist mass viewpoint.The fourth part is the perfection of the connection of litigation and mediation in Marxist mass viewpoint.This part puts forward seven proposals:perfecting legislation,strengthening propaganda,adhering to the principles of mediating voluntary and offering convenience and benefits to people,widening the scope of this mechanism,perfecting relevant systems,perfecting the procedure arrangement and perfecting the mediator team,respectively.
