Research On The Protection Of Creative Copyrights

Creativity is the core of the creative industries,is the motivational power of the spirit of innovation,in today's developing innovative economy,creativity is highlighted in the position in social development.But the creative legal status is not yet clear,the originality can be protected by copyright law is still controversial,ideas are violated phenomenon occurs frequently,which makes it hard for artist's rights are protected,beneath the impartiality of the law.Therefore,the author hopes to through the systematic research of the above problems,this paper emphatically discusses the originality in copyright protection system the necessity,possibility and feasibility of the core issues.In this paper,the main contents include introduction will be divided into four parts,the former three parts,respectively discusses the related concepts of the urgent request of protecting ideas,creative,creative legal attribute,theoretical analysis this paper expounds the ideas shall be incorporated in the copyright object category,especially to unscramble "thought and expression dichotomy" theory to eliminate obstacles;The fourth part from the perspective of empirical analysis,considering the TV program templates closely associated with the creative and nowadays the topic of the heat,in the perspective of TV programs template,as a typical example to analysis the creative in reality of copyright protection,discussed the necessity,feasibility and method of infringement of copyright protection.
