Research On Criminal Protection Of Personal Information In China In The Internet Age

With the advent of the Internet Era,citizens' personal information crimes have become increasingly rampant and breed fraud,blackmail and other serious criminal activities.Combatting this upstream crime is imminent.Article seventeenth of the criminal law amendment(nine)merged two crimes to crime of infringing on citizens' personal information.It expanded the subject of crime and amended the objective aspects of crime.Based on the status of China's criminal legislation on the personal information protection,this article analyzed 200 randomly selected cases of infringing on citizens' personal information.Then,the author discussed crime of infringing on citizens' personal information on the problems existing in the legislation and judicial application,to put forward some suggestions to perfect.The article firstly introduced that citizens' personal information crimes were rampant but criminal law protection were not sound in this field.The author pointed out the bright points of this paper was studying citizens' personal information crimes from the angle of the kind of case analysis.Then,the article expounded the personal information protection under the network era has characteristics of infringement way variety etc.And the artical roundly showed the status of the criminal legislation of personal information from two aspects.Then,the artical randomly selected 200 cases and analysed the characteristics of these cases.The author pointed out some problems,such as fuzzy "personal information" concept.Finally,the artical puts forward some suggestions to perfect,according to the mentioned problems.
