Research On The Legal System Of The Eurasian Economic Union

With the advent of globalization and entrenchment of regional integration,countries around the world have undoubtedly made profound changes in the world economic map.Eurasian Economic Union had a significant impact on the post-soviet space and had important influences on the world economic system.One of the greatest achievement of the Eurasian Economic Union is the establishment and development of legal system.The article includes four parts besides the introduction and summary. The first part introduces the concepts and history of Eurasian Economic Union and then discuss the international legal personality of Eurasian Economic Union .The second part talks about the issue of legal system of Eurasian Economic Union from the perspective of international institutional law.This chapter concentrates on four aspects,including the legal system of the EAEU,the sources of law of the EAEU, principles of law of EAEU,institutions and decision-making system of the EAEU. The legal system of the Eurasian Economic Union have vivid Eurasian feature.The third part uses the method of comparative analysis and make comparative analysis between Eurasian Economic Union and European Union.The main distinction of the Eurasian Economic Union from the European Union might lie in the legal system and the function of organization and make conclusion that the legal system of Eurasian Economic Union is highly formal.The development of the legal system of Eurasian Economic Union is uncertain,because of the crisis of losing efficiency of the legal system,the limitation of the legal system,Ukraine Crisis and Russian economic crisis.The legal system of Eurasian Economic Union is limited and fragile and it is not a valid machine to restrict the action of every member nations.The fourth part discusses the effect of legal system of Eurasian Economic Union on SREB and then shows countermeasures China should take. It introduces the present situation, the causes and analyzes the positive and negative effect of the legal system of Eurasian Economic Union on Silk Road Economic Belt.At last,the article makes some legal recommendations of aligning the SREB and EAEU from the perspective of international law to achieve joint of legal system.
