Jordan V. The Commercial Appraisal Committee For The Legal Review Of Trademark Revocation Cases

With the situation that the names of public characters were registered has repeatedly occurred,more and more cases of right of name have caught our attention,and more and more scholars have discussed this problem fiercely.The right of name is a traditional personality right,the way of its protection is limited.But with the development of society,the situation that names are commercially used is very common now.Issues caused by the situation are difficult to solve under the existing legal system.In this paper,I chose the case between Michael Jeffrey Jordan,State Administration For Industry and Commerce of the People's Republic of China Trademark Review and Adjudication Board and the Qiaodan Sports Co.Ltd as my object,I analyzed and studied the controversial problems in this case,and my purpose is to solve similar cases and explore related theories.Besides,I also want to link theoretical knowledge to actual cases and improve my ability to solve practical problems with my knowledge.In this article,first,I analyze the specific case and the focus of controversy,grasp the whole process of the case.And then I analyze some relevant legal problems behind the focus of controversy.I identity whether the Qiaodan Sports Co.Ltd infringe the right of name of Michael Jeffrey Jordan.And I also analyze whether the controversial trademarks that the Qiandan Sports Co.Ltd have damage prior rights of Michael Jeffrey Jordan.Based on the above study and the facts of the case,I analyze reasons and damages of being registered of public characters,and I also think deeply about the necessity of protecting the right of name that is commercialize in China and some other problems.Then I put forward some advice to perfect protecting the right of name that is commercialize.I also talk about my own understanding and views.
