Organize And Lead The Crime Research On Pyramid Schemes

After World War ?,the US domestic economy needed to be restored.Direct-marketing model has emerged to stimulate sales.Later,multi-level direct sales gradually evolved into illegal pyramid scheme for some of unscrupulous businessmen seeking greater economic benefits.In the 1990s,pyramid scheme was introduced into China by Japan.Because Chinese socialist market economy system was immaturity and imperfection,moreover,people and the government lacked the understanding of pros and cons;there was no administrative intervention and legislative regulation in pyramid selling activities,All above resulted in pyramid scheme spreading in China.The government constantly promulgated relevant judicial interpretation,introduced departmental rules and severely punished the organization leader against pyramid selling crime.Although these steps played a positive role in combating crime,it was still repeated and more intensified due to too rigid legal standards in the prosecution,narrow main scope of the crime,low maximum sentence,lack of judicial salvation of the innocent people tricked into criminal organization and poor communication between the Ministry of Industry and Commerce and Public Security Organs.In view of these shortcomings,I believe that government should improve the legal standard of prosecution,clear the criminal responsibility of active participants,and add the special circumstances and confiscation of property penalties.Additionally,combine South Korea's legislative experience with Chinese national condition to set up Direct-selling Regulations,rescue innocent people deceived in the crime from civil aspects and impose administrative penalties on the staff providing residence and activity place.The combination of administrative means and social means is the better way to curb pyramid scheme and maintain a healthy and orderly development of the socialist market economic system.
