Environmental Civil Public Interest Litigation Research

Under the background that the Civil Procedure Law Amendment put the Environmental Civil Litigation into institutionalized orbit,and the new Environmental Protection Act and the Supreme Court judicial interpretations on the trial of Environmental Civil Litigation have been put into effect,with respect to the situation of the increasingly serious environmental degradation and a large number of lawsuits,the number of the Environmental Public Interest Litigation cases is still not match.In order to break the bottleneck of the development of environmental public interest litigation,and solve the protection issues of environmental public interest,study how to improve the environmental civil public interest litigation system is necessary.This paper first gives an overview of environmental civil public interest litigation.It also expounds the history,development and present situation of the environmental public interest litigation system in China from the environmental civil public interest litigation concept,characteristics and functions of three aspects.Secondly,combined with the judicial practice of civil environmental public interest litigation in recent years,the problems of environmental public interest litigation in China are analyzed from the legal provisions,litigants and the difficulties of the judicial process.Finally,this paper proposes to consummate the system of environmental civil public interest litigation by perfecting the legislation,perfecting the related supporting system,establishing the inter-departmental working mechanism and renewing the trial idea.
