The Third Party Revoked The Lawsuit

In judicial practice,there are more and more cases,in which the rights of the third part are violated.Before the new civil procedure law was enacted,less counterproposals of the protection of the rights and interests of a third person exist.And in the judicial process,it is not ideal.With the prevalence of false action in civil procedure in recent years,it not only infringes on the lawful rights and interests of the parties,also poses a challenge to the judicial authority.The author would like to put forward some humble opinions on the revocation of the third person that is used as the breakthrough point in the essay,and how to improve it to perfection.Introduction,text and epilogue make up this paper.The body part develops in three aspects.In the first part,the revocation is discussed.The second part,why the revocation is applicable will be analyzed.In this part,the author will mainly analyze the existing problems and confusion of this system in the process of case acceptance,the affirmation of the main body.The third part refers to the revocation,the retrial system,the objection to execution of the person not involved in the case,the third person to participate in litigation and the coordinated relations as well.At the same time,various relations of the system and some problems encountered in the process of application will be put forward.The last part expounds the aspects to pay attention to and improve in the judicial practice.Meanwhile,some views of my own on the topic are included.
