Basic Level Procuratorial Committee Functions To Achieve Research

As the highest professional decision making bureau of the procuratorial organ,the procuratorial committee is widely criticized for its operational mechanisms.In recent years,measures have been taken in order for its correction and improvements,through official documents issued by the supreme people's procuratorate,as well as newly introduced practice among all levels of people's procuratorate.However,issues still persist,including ambiguity,low efficiency among daily practice,etc.The role of decision-making,guidance and supervision of the committee is largely compromised due to the lack of normativity,ambiguous responsibility,etc.There exists urgent practical needs for realization of the functions of the procuratorial committee:the rise in the type and number of issues for the committee,the rising quality of reviews from lower departments,and the current new round of the reformation of the judicial system.For the purpose of breakthrough to ensure the proper functioning of the procuratorial committee,measures are needed,including the re-evaluation and re-organization of the legal functions of decision-making,judicial guidance and supervision,the standardization of procedures,resource integration,etc.,with emphases on the access system of the issue under discussion.In specific,The recruitment process of committee member should be re-formulated to include proper mechanisms for admittance,tutoring and quitting.The responsibility and proper role of the committee should be clearly defined and emphasized for important and complex cases.At the same time,existing mechanisms should be strengthened,including the assessment of higher judicial departments,the supervision of inspective departments,and the accountability to judicial staffs.
