Research On Administrative Law Protection Of Personal Information

With the continuous development of the information age,the value of information is becoming bigger and bigger,the free circulation of information promotes the development of market economy,the value generated by the use of personal information is also shown,but followed by a variety of violations of the right to personal information continues to occur,a variety of personal information disclosure or illegal sale of personal information rights caused by the subject of property rights and even the right to life of the news is often seen in newspapers,therefore,the protection of the right to personal information has reached a very urgent moment.From the infringement of personal information right,there are two main violations,one is the government departments and public sector,one is the non-public sector,such as a variety of for-profit enterprises,therefore,this paper puts forward the administrative law protection of personal information,the legal regulation of the two major violations,this paper is divided into four parts.The first part mainly defines the concept and connotation of personal information and personal information right,define the concept of personal information,this paper analyzes the basic connotation of the personal information right,the right attribute of personal information right is analyzed,the conclusion is that the right of personal information belongs to the basic rights.The second part mainly discusses the current situation of administrative law protection of personal information in China,this paper briefly expounds the violation of personal information collection,processing and utilization in China,then it discusses the current situation of the protection of personal information administrative law in our country.The third part mainly discusses the characteristics and Enlightenment of the administrative law protection of personal information,selected three typical countries,the United States is a separate legislative model,the unified model of Germany,Japan's unification of the model,this paper expounds the Enlightenment of different modes on the construction of administrative law system of personal information in China.The fourth part is the suggestion on the construction of the relevant system of the administrative protection of personal information,this paper puts forward some suggestions on the system construction of the two information processing subjects of the government departments and the public functional departments and the non public functional departments,the paper puts forward the corresponding suggestions on the construction of the system.
