Research On The Character Evidence System Of Domestic Violence Cases

The promulgation of the anti-domestic violence law of the People's Republic of China in 2015,which safeguards equality,harmony,civilized family relationships and promotes family harmony and social stability.Handling domestic violence cases fairly is the fundamental measure to implement the spirit of legislation.They have been the focus of legal research,which are the problem of proof and the system of character evidence in the case of domestic violence.In the study of the system of character evidence,we must grasp the connotation of character evidence and its value firstly.So we can provide a theoretical basis for the study.For proving the necessity,this article analyzed the problem of cases.There is less evidence of admissibility and difficulty in collecting evidence.On the other hand,the burden of proof is uneven and the standard of proof is too high in link of proof,which they cause the right of prosecution and defense imbalance in private prosecution of domestic violence.For the character evidence,there is strengthening the facts of domestic violence and bringing little prejudice on the trial mode,which determine the feasibility of the study.For the construction of character evidence system,we should put forward the suggestion of adding character evidence,transfer the burden of proof,reduce the standard of proof,put forward the witness to testify and character investigation system,which construct the character evidence system in the case of domestic violence.
