Research On The Authority Of Local Governments To Borrow From The Perspective Of The Constitution

Since China implemented the reform in 1994,the central fiscal revenue accounted for more and more big,at the same time the proportion of the local finance income is more and more small,at the same time,due to the increasing local affairs,spending more and more,lead to the fiscal deficit is bigger and bigger,therefore,different parts of the Chinese government can only different extent by debt to make ends meet,financial burden is growing.Therefore,comprehensive and correct understanding local debt problem,the reasonable division between central and local government entity,also give place to the corresponding financial resources allocation,it is of important theoretical and practical value.This paper first introduces the basic theory of local debt rights granted on the basis of.Second through the introduction of the existing borrowing authority of local governments in our country and its disadvantages,summed up the problem restricting the construction of local debt system in China,finally proposed the present stage in the framework of the constitution measures to improve the local debt system in China need: firstly emphasizes the central and local fiscal decentralization in China’s constitution,including the basic idea of fiscal decentralization,basic principles and basic system of the constitution,the centralization and decentralization of the organic unity as the core of constitution mode;Followed by the rule of law regulation mechanism of local government debt,including: the rule of law of our country local government debt regulatory model selection,the governments at all levels of local government debt regulatory mechanism and constraint mechanism of the rule of law of local government debt market.
