Research On Criminal Responsibility Of Juvenile Delinquency

With the rapid economic development and a high degree of network,juvenile delinquency problems with the economy and the network has become more and more negative impact,and have deteriorated trend.In recent years,juvenile delinquency has shown the characteristics of younger age,violence and grouping.The emergence of this situation is that it has a great connection with the family neglect education,the second is the negative impact of social development,The misunderstanding of the law.China's criminal responsibility for minors stressed that "save the main,supplemented by punishment," the policy,which in the relevant legal provisions and judicial interpretation can be reflected.With the intensification of juvenile delinquency,China has made continuous changes and improvements to the legislation and policies on criminal responsibility of minors.However,criminal policy on juvenile "education-saving" has been used for so far.See our protection of minors.With the change of society,China's criminal policy on juvenile delinquency in the practice of the problems presented by more and more obvious,because of the lack of juvenile delinquency for the legislation led to the practice of a series of contradictions are gradually highlighted.Based on the introduction of typical cases,this paper analyzes the causes of the increase of juvenile delinquency in our country,and finds out the shortcomings of our country about the existence of criminal responsibility,such as the age of criminal responsibility,Minors of the penalty for the application of defects,such as defects.This paper puts forward some suggestions on perfecting the criminal responsibility of minors in China from the three aspects of criminal responsibility age,penalty and torture,and puts forward some suggestions on how to improve the criminal responsibility of minors in the light of the basic situation of our country and the good system of the criminal responsibility of the juvenile.
