Generally speaking,genetically modified foods(GMOs)mean the food which contains transgenic ingredients.In other words,GMOs are food,raw-food material and food additives produced by flora and fauna and microorganism which have been improved by transgenic technology.Recently,there is no sufficient scientific evidence can be proved that the GMOs have the potential risk to the biodiversity and people's healthy.Therefore,many countries have the different attitude to GMOs,which take the great challenges to the international provisions of GMOs.There are two international norms: the Cartagena Protocol on Biosafety(CPB)and SPS,TBT agreement in WTO frame.CPB aims to protect the biodiversity and people's,the others aim to protect trade freedom.They have the conflict between principles and provisions of GMOs because of disparate benefits.How to coordinate the conflicts and improve international provisions of GMOs is still a problem.This thesis utilizes the case analysis and comparative analysis methods.The first chapter describes a trade dispute about the GMOs,and then finds the nondeterminacy of the international legal states of precautionary principal.The second chapter compares the different two international treaties of the GMOs,and then finds they have many different provisions about the GMOs.The third chapter will compare the provisions about the GMOs of different countries,and find if there are some measures which enacted by international organizations can be taken to resolve the contradiction.America adopts the principle of scientific evidence,EU adopts the precautionary principle,and Japan applies the compromise proposal.Finally,some advices will be proposed to solve contradiction between two treaties,and then enhance international cooperation to coordinate the different provisions of GMOs among countries.
