Research On The Legal Issues Of Personal Data Security Supervision In The Era Of Big Data

With the development of the technology of data,the globe,from scientific resea rch to medical treatment,from finance to the Internet,various industry the amount o f data that are long rights at a rapid pace,thus one can imagine the amount of data.Human society has entered a mass production,sharing,application and managementdata in a new era of information.Big data has gradually developed into the most key factors of production and product form,is also the current social transition fromindustrial economy to knowledge economy important features.Big data era,a seriesof change also brings a series of new challenges at the same time,data informatio n security problem arises at the historic moment,big data in such aspects as technol ogy,management and law faces new security threats and challenges.In this paper,the first chapter expounds the concept and connotation of big dat a,personal data is defined under the background of big data,personal data processin g steps such as basic theory knowledge,then details the background of big data in t he collection of personal data,storage,and exchange in each processing link faces n ew security risks,from four aspects this paper expounds the necessity of personal da ta security regulation.The second chapter analyzed the safety regulation in the regulatory concept,prin ciple,subject,way,form a complete set of the present situation of the system,and based on the present situation of discusses the problems and shortcomings of person al data security regulation,including the concepts and principles need to be updated,the supervision of the law is not sound and supervision subject vacancy,regulatoryway to shift,regulatory lack problem such as auxiliary means.The third chapter in this paper,mainly listed overseas practice of personal data security regulatory practice,this part USES the method of comparative study of the European Union,the United States and Japan personal data security regulatory practi ce experience,in the European Union,the United States and Japan are typical perso nal data security regulation analysis of carding and briefly elucidated.Summed up th e overseas experience is worthy of reference for our country supervision,such as pe rsonal data supervision should be brought into the regulatory framework,clear regula tion subject of personal data,set up a personal data processing industry self-disciplin e mechanism,etc.The fourth chapter based on the elaboration and analysis of former three chapte rs,personal data various legal problems existing in safety supervision,perfecting pers onal data security regulatory proposal is put forward.First proposed to update the co ncept and principles of supervision from supervision concept and principles are clear.Secondly,the paper puts forward perfect the regulation of legal norms,specific rec ommendations formulated and issued the corresponding field of the basic law and gu idance,changes to the blank and the shortcomings of the existing laws,to formulatesupporting regulations and rules of the industry.Third,multi-level regulation subject,on the regulatory body for the central and local governments,which combines unifi cation effective self-discipline organization should play the role of regulation.Fourth,the transformation of the mode of regulation and suggest to strengthen the coordina tion and regulation subject to strengthen the construction of regulators internal contro l mechanisms,and promote the development of regulation technology.Fifth,improvethe regulation of auxiliary means,including the introduction of credit system and in formation disclosure system,build a dispute settlement mechanism is effective and pr actical.
