| Natural persons and legal persons shall enjoy right reputation,throughout most of the current law of our country are the related research of the natural person reputation,and the related protection for the natural person reputation damaged.For corporate reputation protection related issues,there are a lot of shortcomings.This article is mainly for enterprise as a legal person of relevant problems is analyzed,the enterprise legal person’s reputation is an important right in market competition.Due to the blank of legislation,judicial practice is not a unified standards,when an enterprise as a legal person’s reputation damage so it is hard to get the corresponding relief.An enterprise as a legal person enjoys reputation should be protected by law.With the development of social economy,the enterprise as a legal person and social development in the market has played an increasingly important role in the process.In this paper,through the analysis of the three cases to analyzes the related problems of reputation in the enterprise as a legal person,thus a deeper understanding of the legal person of relevant rights constitutive requirements and how to protect the reputation of the enterprise as a legal person,and reflect today’s political foundation,from now to think corresponding remedy and further improve the measures.Writing of this paper consists of the following parts:The first part introduce several cases of selected first,second is thecase in court trial results,and then find out the law of the similar case of contention.The second part is on the first part of find out the legal problems of the legal dispute focus of analysis.The third part is for the above legal thinking,legal problems of the case has the realistic meaning and effect of measures are put forward.Freedom of speech and the balance of corporate reputation to protect,perfect the laws and regulations and the relevant judicial interpretations,improve their corporate reputation damage compensation system. |
