The police violence as the national machine,undertake the task of the special and important.In order to protect the country and people's property and life safety,given the police state limited rights,with possibility to have harm personnel for compulsive sampling with serious illegal and criminal suspects rights,and use all kinds of method,and even ordinary people to ban the use of power,such as: monitoring,monitoring,power,etc.These "privilege" award for the police to carry out the work provides a favorable safeguard,but if use undeserved,may cause infringement to countries and the interests of the people.In recent years,the police because of improper behavior in the process of law enforcement,shall be investigated for criminal responsibility by the phenomenon have become common,but the police tort in the law enforcement process less someone mentioned,especially after the tort liability law,the tort liability shall be investigated of strength will increase further.This article focuses on the police enforce the law in the process of civil tort liability,the tort liability of general situation both at home and abroad,and relevant compensation law development in China,aims to emphasize the importance of the police law enforcement tort of civil liability.The first part of this paper expounds the types and situation of the infringement of the police in China,the second part illustrates the relevant national compensation policy and the problems that exist in the police law enforcement,the third part of the police law enforcement fault has carried on the detailed instructions for state compensation,the last chapter of the police law enforcement supervision and illegal illegal behavior to compensate ideas and Suggestions are put forward.
