Private lending cases increase year after year,the number of criminal cases related to borrowing also increased year by year,such as illegal detention,intentional injury or murder.In this pape the author hangded cases of private lending as example.(litigation value of 32000000 RMB,alleged false value of 10000000 RMB).This article records the whole process of the case,also recorded the legal disputesBased on the procuratorate's supervision responsibility,combined with practical work,explain the causes of the folk lending false litigation,have not abide by the principle of good faith,the judge is not perform their duties,abuse of civil mediation,the parties who abuse self-admission,have the illegal cost is low.False lawsuit means to forge the loan contract,forge the loan certificate,forged credit assignment agreement.Procuratorial organ must strengthen legal supervision function,maintain fairness and justice.The authors suggest that strengthening citizens amount credit system,and strengthening the Court to review the case,clues to strengthen the transfer between departments and increase penalties against the law.Let a person feel gratified,at the end of these cases,the ninth amendment of criminal law passed,false charges announced,solved the problem of the procuratorial organs supervise investigation difficult.I think this article can be used for reference on the procuratorial work.
