Compensation For Pure Economic Losses In The Oil Pollution Damage Of Ships

Oil pollution leaked from ships has been increasing.For the pure economic loss,the attitude of each country is different,but the actual results are pretty similar.Only very few types of pure economic losses are indemnified,which includes oil pollution caused by the pure economic loss.In addition,the international conventions also recognize pure economic loss damages for oil pollution.At present,China's Maritime Law also recognizes oil pollution damage by the judicial interpretation issued in 2011,and limits the scope of damages by proximity.For China,the theoretical basis of compensation for pure economic losses caused by oil pollution is that,on the one hand,fishing is licensed and is legitimate benefit protected by laws,on the other hand,pure economic loss caused by oil pollutions is short of means of protection.After the study of China's practice in related fields,the state should still legalize purely economic loss damages in the Maritime Law,and the calculation of the loss should be further clarified.
