Civil Prosecution Advice

"The People's Republic of China Civil Procedure Law(Revised Edition)came into force on January 1,2013,one of the highlights of the new civil procedure law is from legal this relatively high order of civil procuratorial suggestions to regulate,extent enhance the legal status of civil procuratorial suggestion.The number of civil procuratorial suggestions also along with significant growth exceeds the number protested by procuratorial organs,but the civil procuratorial suggestion adoption rate did not achieve the expected results.The purpose of this paper is to investigate the origins and the present situation of civil prosecution suggested,the existing problems are discussed and analyzed on the basis of our civil prosecution attempt to proposed future development of reasonable assumptions.This thesis is divided into four chapters:The first chapter titled Overview of the proposed civil prosecution.This chapter from civil prosecution suggested connotation of a clear definition,nature and characteristics,laid the theoretical foundation for the civil prosecution proposed development direction.The second chapter,entitled Civil Procuratorial recommendations origin.This chapter attempts to stroke along the recommendations of the Development of Civil Procuratorial origin,from a legal basis,legal basis,legislative and practical background four aspects of civil procuratorial recommendations origin were studied.The third chapter,entitled Civil Prosecutorial practice recommendations Problems and Causes of.This chapter analyzes the civil procuratorial suggestion existing problems,mainly civil prosecution and the number of recommendations adopted by the growth rate is not proportional to the proposed civil prosecution applicable standards are not clear,two-way feedback pathway civil prosecution recommendation is not smooth.To solve these problems analyzed its causes,mainly legislative defect,different understanding of the concept of procedural rules and supervisory procedures imperfect.The fourth chapter entitled Improvement of Civil Procuratorial suggested ideas.This chapter of the Civil Procuratorial proposed future road to try thinking,they are given their own legislative proposals,collaboration,process,accountability,evaluation five levels envisaged.
