With the development of information technology,the age of the Internet has come.Meanwhile,virtual property right as a new kind of right becomes the issue argued in theory and practice,which is attached to the virtual word and network platform.But,it is also closely related to the real society.People pay more and more attention to it because of the continuous emerging of disputes about it.There is no denying that virtual property right needs to be regulated by legal norms.On March 15,2017,the General Principles of Civil Law of the People's Republic of China have been adopted.In the General Principles of Civil Law,virtual property right is clearly stipulated as the legal right for the first time.Moreover,it is of great value to regard virtual property as one of the object of civil rights in the chapter of Civil Rights.This paper expounds the jurisprudential basis of the virtual property right from three aspects.The first aspect is to analyze from the angle of theoretical basis,expound the basic connotation and ownership of virtual property,demonstrate its property attribute,analyze the legal attribute of virtual property right,and affirm the new right theory.The second aspect is based on the requirements of economic development and the internal legal system to carry out the analysis of the realistic basis.It has become an inevitable trend to further regulate the virtual property rights.The third aspect is to select the relevant legal norms of the United States,South Korea and Taiwan as the typical legislative examples to analyze the basis of comparative law.At the same time,the prospects of the legal level and other institutional aspects are made for the further regulating of the virtual property right.
