Research On Legal Issues Of Financing Supervision Of Microfinance Companies

Since the issuance of the Guiding Opinions on Piloting Small Loan Companies in 2008,the micro-credit company has been developing for 10 years and has played an important role in guiding the flow of private capital,making up for the lack of funds for SME,and serving "agriculture,rural areas and farmers".However,the mode of operation of "small loan-only non-existence" of the micro-loan company has led to the lack of funds of the small-loan company and how to raise follow-up funds has become an urgent problem to be solved for the sustainable development of the small loan company.At present,the Regulation on Non-deposit Lending Organizations is in the stage of soliciting opinions and there is no systematic and formalized legal regulation on the financing supervision of small loan companies.The existing relevant regulations have the problem of too low legal rank and lack of unified supervision.They have not clearly defined the nature of micro-finance companies and financing.Various provinces and cities in the legal supervision of financing continue to explore.One after another promulgated the interim measures related to the financing of small loans.However,in order to realize the sustainable development of small-loan companies,our country should also make it clear that the legal nature of small-loan companies and the regulatory authorities of small-loan companies should,in combination with the exploration experience of all localities in our country,formulate suitable small-loan companies nationwide Financing regulatory laws and regulations;the same time,we also need to learn from the successful experience of the United States NDTL,making the financing of small loan companies in the regulation of the Chinese characteristics,based on the international standards.
