Research On The Rights Relief System For Civil Offenders

Cases involving false and malicious litigations are becoming more and more common.The rights of people who are affected by the outcomes of such cases,however,do not currently have the opportunity to contribute their own information in the judicial process.This is because,through no fault of their own,they are unable to join cases.Our country currently has a system,which balances the demand for civil rights on one hand,and procedure requirements on the other.This system favors the outsiders in person not involved in the cases.For example,legislation such as individual civil rights,rules surrounding retrials,appeals,and third party litigants.Although the existing system to a certain extent,safeguard the rights of an outsider,ways to provide relief for an outsider,but comprehensive an outsider the entire contents of the right remedy system,there are many problems,should be improved.The present paper discusses the outsider right remedy system in China and the problems with the existing legislation and judicial relief system.Various system relationships will be discussed along with their existent value.The discussion then focuses on the problem of an outsider right remedy system,which reflects the current status quo of security procedures.The paper concludes with suggestions on how to improve optimization.
