Speaking of the protection of international humanitarian law for persons deprived of their liberty,the Fourth Geneva Convention of 1949 and its Additional Protocol I cannot be ignored as an important component of international humanitarian law,both of which deal with international armed conflicts.The issue of the protection of persons deprived of liberty was stipulated.International humanitarian law allows a party to the conflict to take custody or detention at the time of the conflict,but for the purpose of protection,not as a measure of deprivation of liberty in detention or detention.In accordance with the common article 3 of the 1949 Geneva Conventions and the Second Additional Protocol,persons deprived of their liberty due to conflicts must be treated with humanity under any circumstances.The rules for the protection of persons deprived of their liberty in international humanitarian law are very similar to those applicable to prisoners of war.The current armed conflicts in the international community are frequent and the number of people deprived of their liberty due to armed conflicts continues to increase.They are also at risk every day.Therefore,the issue of the protection of international humanitarian law for persons deprived of liberty has become the subject of this paper.Based on this,the current international community's protection of people deprived of their liberty is analyzed.We can see that neither the ICRC's efforts to visit persons deprived of their liberty nor the Copenhagen Principles reached in the 2012 Copenhagen process have achieved the effect of protecting persons deprived of their liberty from a legal perspective.Current international humanitarian law There is no specific enforcement and monitoring mechanism for the protection of persons deprived of their liberty,and the protection of persons deprived of their liberty in non-international armed conflicts is also faced with the problem of insufficient application and provisions of international humanitarian law.In response to the above issues,this paper proposes to improve the protection of people deprived of liberty,hoping that international humanitarian law can provide better protection for people deprived of their liberty.
