In recent years the rapid development of China's socialist market economy,the relationship between people more closely in daily life,the resulting social problems also emerge in endlessly,workplace sexual harassment is one of the typical representative,a new generation of Chinese people pay more and more attention to protect their rights.In our country,however,due to the immature workplace sexual harassment law regulation,the victims are often difficult to properly remedy,in this article,through carding and clear definition of sexual harassment in the workplace,from the administrative law,labor law and tort law of these three paths to choose the tort,as a means of solving disputes,its unique context is to keep moving forward on the civil code of our country to develop,for the protection of personality right,especially sexual rights gradually on the agenda,academic scholars have put forward the related concrete personality right in separate calls,presumably this call can be achieved,if the future of human rights protection in China will set foot on a new level.This paper to solve such a complex social problem workplace sexual harassment,advocates combining the existing legal system to strengthen the top-level design at the same time,in the framework of the general civil law to build the concrete personality right system of tort liability.And by comparing the different regulations of different countries and regions,we find out the regulations that are suitable for our country.Administrative and judicial measures of perfecting our country's at the practice level,the concrete content includes strict employer responsibility,solve the problem of information asymmetry between workers and employers as well as the specific judicial practice standard three aspects,provide a reference for solving the predicament of sexual harassment in the current society.
