On The Reduction Of Child Support Obligations

In reality,many parents do not raise their children,even worse,they commit acts of abandonment,betrayal,abuse,sexual assault,etc.which seriously infringe upon the legitimate rights and interests of their children.There are various reasons for frequent parental infringements on children,one of which is the low cost of illegality.Our laws provide absolute child filial support obligations,and there are no relevant provisions for reduction or exemption.Even if the parents seriously infringe upon the legitimate rights and interests of their children,the children still need to fulfill filial support obligations to parents.This provision encourages,to some extent,the occurrence of parental violations of children.Although the reduction and exemption of child filial support obligations proposed in this paper will impact certain traditional concepts of our country to a certain extent.But in the long run,it is more conducive to build a parent-child relationship with consistent rights and obligations,and form the good interaction of the obligations between parents and children,promote family harmony and stability.From the current legislative status and judicial status quo of the filial support obligations in our country,the author analyzes the necessity of the reduction and exemption of filial support obligations in our country;learns from relevant legislation experience in other countries and China Macao,Taiwan;demonstrate the justification by fair value,consistency of rights and obligations,the principle of exchanging harmonization,and the expectation possibility principle;then,combines with the current situation of the social security of the elderly in China,analyzes the feasibility of the reduction and exemption of filial support obligations.Finally,the author proposes the preliminary framework of the reduction and exemption of filial support obligations in China.It is designed to be beneficial to the improvement of the relevant legal provisions concerning the child support obligations of our country.
