In August 2015,the amendment to the criminal law(9)first introduced occupational prohibition to the level of criminal law.While the new amendment of criminal law of the system to certain rules,but as a result of professional ban system provisions are too simple,suffering from academic controversy in some places,such as: qualitative unclear,unclear punishment scope,applicable objects have objection,announcement of time making clear the executive main body and uncertain,applicable procedures such as blank.Through the analysis of these issues research,professional banned should belonging to the category of security measure in nature,its applicable scope includes both including been shall only be inflicted upon principal punishments by criminal supplementary punishment of offenders,and choosing a ban on the court can only to natural persons,the unit should not be applicable.The public security organs are more capable of carrying out this important duty than other organs.In terms of program,through comparing with other countries similar system research,it is necessary to construct the corresponding rights mechanism in our country,evaluation mechanism and the introduction of reprieve system regularly,in order to better improve the professional banned relevant procedures.In addition,the establishment of occupational prohibition system should be taken as an opportunity to construct a system of security disposal system in China.
