Marriage Rape Into Sin Research

"Marital rape",as a hidden sexual violence,destroying the physical and mental health of married women,has a bad social impact.At present,a considerable number of countries in the world have already achieved the criminalization of marital rape.However,there is still no explicit provision in the legislation of our country,and the theoretical community still holds different opinions on its legal nature,which makes the judicial results of marital rape cases differ greatly in the judicial practice and puts forward the challenge to the stability and seriousness of the current judicial system.From the perspective of safeguarding women's rights and interests,women's sexual autonomy in marriage and family as a natural right that they enjoy,should be protected,especially the protection of the law.And the most powerful means of legal protection is to clear legal regulations of marital rape.It is to say,commit marital rape.This article starts from relevant cases,analyzes and argues different views of the criminal law community on the problem of marital rape,discusses the necessity of marital rape as a crime and proposes a specific legal framework for the crime of marital rape.The purpose is to make sanctions for marital rape lawful.At the same time,legitimate rights and interests of women and the stability of marriage and family can be maintained better.
