Research On Legal Issues Of Competition Restrictions Under The Scope Of Labor Law

In recent years,the flow of talents among enterprises has become more and more frequent,the competition about talents among various industries is increasingly fierce,the phenomenon of talent job-hopping and resignation is common,which brings great challenge to the protection of business information such as business secrets of employing unit,and leads to the cases of competitive restriction disputes rising year by year.This has led to a series of discussions on the legal issues of competitive restriction.The competitive restriction in the field of labor law is not only the balance between the laborer and the employing unit,but also the defender of the market competition order,which has very important significance.This paper analyzes the problems in legislation and judicature of the current competitive restriction in the field of China' s labor law by analyzing three cases in the ten classical cases published by two courts in Beijing in recent years.And with the help of the analysis of the case,combined with the controversy about these problems,propose relevant solutions,I hope these can promote the improvement of competitive restrictions in the field of labor law.
